Venezuela TPS Protections Revoked by DHS

Temporary Protected Status (TPS) allows nationals of designated countries to live and work legally in the US when their home country faces ongoing armed conflict, environmental disasters, or other extraordinary conditions. Venezuela had been designated for TPS due to its humanitarian crisis. On January 28, 2025, DHS Secretary Kristi Noem vacated the Biden administration's final extension of Venezuela TPS, which had been set to protect holders through October 2026. On February 5, she also announced the termination of the separate 2023 TPS designation for Venezuela.

The terminations have been challenged in federal court. The legal situation for Venezuelan TPS holders remains unsettled as courts continue to consider the cases. Do not assume your existing TPS status or Employment Authorization Document (EAD) is still valid — check your specific expiration dates carefully.

If your TPS or work permit was tied to the vacated Biden extension, consult an immigration attorney immediately. Some Venezuelan nationals may qualify for other forms of protection, including asylum. Do not delay — acting quickly may preserve options that could otherwise close.
