Description

EB-5 is for people who make a substantial investment in a U.S. business and create at least 10 full-time jobs for American workers. If you invest in a rural or high-unemployment area (called a Targeted Employment Area or TEA), the minimum investment is $800,000. For all other areas, the minimum is $1,050,000. You do not need a job offer or employer — you are creating jobs, not taking one. This is one of the most complex and expensive immigration paths, and Chinese nationals face very long waits due to high demand.

💡 Tips to Speed Up and Prevent Denial

🔵 Quality

  • Source of funds documentation is the most common reason EB-5 petitions are denied. USCIS requires a complete paper trail showing where every dollar of the investment came from. Start documenting this well before you invest. The cleaner and more complete the trail, the stronger your petition.
  • Your investment must be truly "at risk" — not in an escrow account waiting to be released. USCIS requires that the capital is actually invested and committed when you file I-526E. Funds sitting in escrow that will only be released upon I-526E approval may not satisfy this requirement. Work with your attorney on timing.

🔴 Avoid Denial

  • Research Regional Centers very carefully before investing. USCIS termination of a Regional Center after you invest can put your entire petition at risk. Ask for: the Regional Center's entire history with USCIS, completed projects and their outcomes, investor I-829 approval rates, and independent legal review of offering documents.
  • File I-829 early — within the first days of the 90-day window. I-829 processing takes 18–36 months. If your conditional green card expires while I-829 is pending, your status is automatically extended in most cases, but it is better not to let this happen. File as early as possible in the window.

  • For China-born investors: ask your attorney about "reserved" EB-5 visas. A portion of EB-5 visas are set aside for rural projects, high-unemployment area projects, and infrastructure projects. These reserved visas may be accessible to Chinese nationals faster than the general EB-5 queue.
